Absztrakt
A vizsgálat négy alapjog – a tulajdonhoz való jog, a tisztességes bírósági eljáráshoz való jog, a véleménynyilvánítás szabadsága és a közérdekű adatok megismeréséhez való jog – elemzésén keresztül mutatja be a történeti alkotmány szerepét.

Summary – Fundamental Rights and the Achievements of the Historical Constitution in the Case Law of the Hungarian Constitutional Court
This paper examines the relationship between the achievements of the historical constitution and modern fundamental rights within the framework of the Fundamental Law, with particular regard to the case law of the Constitutional Court. The central question of the research is whether the historical constitution is actually capable of influencing the content of fundamental rights, or whether it primarily plays a role in interpretation and legitimization within constitutional reasoning.
This research paper examines the role of the historical constitution through an analysis of four fundamental rights: the right to property, the right to a fair trial, freedom of expression, and the right to access information of public interest. Based on this analysis, it can be concluded that the achievements of the historical constitution primarily provide an interpretive framework that emphasizes the historical continuity and embeddedness of individual constitutional values.
The study concludes that the role of the achievements of the historical constitution in fundamental rights jurisprudence is limited, but not insignificant. Their significance lies primarily in the fact that they provide a historical and value-based backdrop for constitutional interpretation and reinforce the integration of individual fundamental rights and constitutional principles into the Hungarian legal development. The historical constitution, therefore, does not transform the modern system of fundamental rights but contributes to constitutional reasoning by serving as its interpretive framework.
